NEW & NOTEWORTHY Examining CMS' New Approach to Federal Medicaid Spending in Cases of Potential Fraud  As part of its new emphasis on potential fraud in Medicaid, the Trump administration is changing long-standing approaches for adjusting federal payments to states when fraud is suspected. A new KFF issue brief examines the shift in approach and why it creates uncertainty for state budgets, with potentially major implications for Medicaid providers and enrollees. The Centers for Medicare and Medicaid Services (CMS) is currently focused on potential fraud in Minnesota and three other states with Democratic governors (California, Maine, and New York), but the changes could have broader implications. The House Committee on Energy and Commerce has sent requests for information about potential Medicaid fraud to 11 states (including two with Republican governors). In the past, CMS has typically denied Medicaid funding to states when fraud is identified (commonly through an audit). Under the agency's new approach, CMS may deny Medicaid funding when fraud is suspected, which can have more immediate consequences, may place a much larger share of federal spending at risk, and could shift the burden of proof to states to obtain federal funds. Although much remains unknown regarding the subsequent legal and administrative processes, CMS' efforts in Minnesota suggest that somewhere between 10% and 30% of its federal Medicaid funding could be at stake.
